Thank you for purchasing a Titan product. All Titan products including doors, gates, shutters, enclosures and any custom work, carry the following Limited Warranty (the "Warranty"): What does this Warranty cover?This Warranty applies if you are a residential purchaser, and covers, under normal and proper use and normal conditions and as long as the product was installed by an authorized Titan installer or dealer, any defects or malfunctions, including rust, relating to the structural integrity of your Titan product's metal structure and framing, including all welding (the "Metal Product and Framing Warranty"), and covers any blistering, cracking and fading of a product's Powder Coat Paint Finish (the "Powder Coat Warranty"). All other components of the product, including Textilene sunscreen material, lock hardware, bug sweeps, weather-stripping, closers and composite materials are covered by the original manufacturer applicable warranties, if any. What will Titan do?If any part covered by the Metal Product and Framing Warranty or Powder Coat Finish Warranty, when used properly, is found upon inspection to be defective, Titan will replace, recoat or repair, as applicable, the defective part or parts without charge. In addition to the foregoing, if your home is burglarized and entry was accomplished through a Titan security door, locked with a double dead bolt supplied and installed by Titan, Titan will pay your insurance deductible up to $1000 or replace as applicable the damaged Titan security door at no charge (the "Home Protection Warranty"). Replacement items may vary in style due to changes in suppliers and product. Not all colors can be reproduced if colors have been discontinued. Titan is not responsible for securing the property while warranted items are being repaired or replaced. How long does coverage last?The Metal Product and Framing Warranty and Home Protection Warranty will last for as long as you own your Titan product, and terminates if you sell or otherwise transfer the product or the property upon which it was installed. The duration of the Powder Coat Finish Warranty is five years from the date of purchase. How do you get service?To make a claim under this Warranty, send a brief written description of the problem, plus proof of purchase, to Titan at: 973 N. Colorado Street, Gilbert AZ. 85233 Attn: Warranty Claims. To make a claim under the Home Protection Warranty, you must also submit a copy of the police report relevant to the illegal entry and proof of your applicable insurance deductible. What does this Warranty not cover?Any problem caused by abuse, misuse, failure to maintain warranted item properly, adjustments due to settling of the structure that the product is mounted on, or acts of God, are not covered. This Warranty also does not cover screen material pushed out of their spline groove, defects regarding any natural wood products encompassed within the product, and (except to the extent covered by the Home Protection Warranty) damage to your home caused by vandals, break-ins, or attempted break-ins. No part of this Warranty applies if you modify the product in any way, including installing or modified any lock. The Powder Coat Warranty does not apply if the integrity of the finish is broken by scratching, chipping, misuse or any other circumstances beyond our control. Except as provided under the Home Protection Warranty, this Warranty does not cover damages in excess of the purchase price. Incidental, special or consequential damages are not covered by or recoverable under this warranty. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion of incidental or consequential damages may not apply to you. Limitation on Implied Warranties. ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARISING UNDER STATE LAW ARE LIMITED IN DURATION TO THE PERIOD OF COVERAGE PROVIDED IN THIS WARRANTY. Some states do not allow limitations on how long an implied warranty lasts, so the above limitations may not apply to you. How state law relates to this warranty.This warranty gives you specific legal rights and you may also have other rights that vary from state to state. Rolling Shutter WarrantyLIMITED WARRANTYManufacturer hereby warrants to Purchaser that the Shutters will be free from defects in material and workmanship for a period of five (5) years from the date of installation, electrical components for a period of five (5) years from the date of installation, Lifetime Warranty on axles and Bearings & Hub Assembly. And that the installation performed by Seller hereunder, if any, will be free from defects for a period one (1) year from its completion. This limited warranty only extends to the original purchaser in the event of such defects. All labor is included for one (1) year from the date of installation. All labor performed after one (1) year will be billable at the current service call rates in effect at the time service is rendered. Seller will repair or replace, in its sole discretion, all or any portion of the Shutters that Manufacturer determines to be defective n order to obtain service under this limited warranty. Batteries, when used, are warranted for one year. (a) This limited warranty is expressly in lieu of all other express warranties. Any implied warranties with respect to the Shutters are limited to the five-year period described above and any implied warranties with respect to installation performed hereunder are limited to the one-year period described above. (b) This Limited Warranty will not apply to installation work or to all or any portion of the Shutters that has been subjected to acts of God, accident, negligence, alteration, abuse or misuse (including but not limited to, installation or use of the Shutters in a horizontal rather than a vertical track), or has not been maintained properly. This limited warranty will not apply if the Shutters in connection with which a part not supplied by the Seller has been installed or used. (c) Contractor is not responsible for existing structural defects, dry rot or code violations; no repairing, plastering, carpentry or decoration is included unless specifically charged for and specified in wiring herein. INSTALLATIONIf installation is required hereby, Seller hereby agrees to use its best efforts to install the Shutters in a prompt manner and to the extent reasonable, in the order in which this Agreement is received. In any event, Seller will not be liable in any respect for delay in the manufacture, delivery or installation of the Shutters. REMEDIESAny failure by Purchaser to pay that part of the Total Purchase Price due on installation of the Shutters or any refusal by Purchaser to accept, or to permit Seller to install, all or any portion of the Shutters will constitute a breach of contract of this entire Agreement. In the event of any breach of this Agreement, Seller will be entitled to recover the full purchase price of the Shutters, without deduction or offset, together with any installation costs and incidental damages, including, but not limited to, attorneys' fees and interest on the unpaid balance at the rate of eighteen (18) percent per annum from and after the date of such failure or refusal, in the event of any breach of this Agreement by Seller other than breach of warranty. Purchaser's remedies will be limited to repayment of the purchase price paid upon return of any Shutters for which payment was made. GOVERNING LAWThis Agreement will be governed by and construed in accordance with the laws of the State where executed. This agreement shall not become binding on seller until accepted by an officer of seller. |
